Biography

Lisa A. Lori is a partner in the firm's litigation and intellectual property practice groups.  In the field of litigation, Ms. Lori maintains a national trial practice, with an emphasis on complex business disputes involving employment, intellectual property, contract, real estate and partnership/shareholder matters.  From fast-moving injunction proceedings and jury trials to arbitrations and mediations, clients bring their high-risk business disputes to Ms. Lori.  While she has successfully litigated cases across the nation in multiple courts and arbitrations, Ms. Lori understands the expense and risks associated with litigation.  Thus, a large part of Ms. Lori's practice involves developing preventive measures for her clients to minimize the risk of litigation and on resolving matters cost-effectively through negotiation and alternative dispute resolutions processes, such as mediation and arbitration.

In the field of intellectual property, in addition to litigating trademark, trade secret, unfair competition, copyright and data privacy litigation matters, Ms. Lori develops domestic and international brand protection strategies for her clients.  She also negotiates licensing agreements and arrangements, and handles transactions involving the sale or acquisition of intellectual property.

Ms. Lori has broad insights across many disciplines, and is equally comfortable in the courtroom, the board room and at the negotiating table.  Ms. Lori's keen ability to problem-solve and navigate through complex laws, contracts, administrative agencies and courts makes her highly sought after as a lawyer and counselor to institutional and corporate clients and individual entrepreneurs.

Representative Matters

Ms. Lori's representations include:

  • Serving as lead counsel for a labor union in a highly publicized dispute among owners of The Philadelphia Inquirer, Daily News and Philly.com, and securing a precedential victory for the union in its petition to intervene in the litigation.  See In re Interstate General Media Holdings, LLC, Del. Ch. Ct., Case No. 9221 VCP;
  • Leveraging a $10 million settlement for three partners who were ousted from an international business;
  • Obtaining a multi-million dollar arbitration award (with the American Arbitration Association) on behalf of a direct response marketing company in a breach of contract action against a large cosmetics company;
  • Obtaining a complete defense verdict at trial for a NYSE cable television company in a case brought against it by an owner of a large apartment complex involving claims under complex FCC Regulations.  See Healy v. Comcast of Southeast Pennsylvania, Inc., United States District Court for the Eastern District of Pennsylvania, C.A. No. 03-5773;
  • Defending a lender in a $2.9 billion resort and casino development on the Las Vegas Strip with respect to claims for fraud; See Brigade Leveraged Capital Structures Fund, LLC v. Fontainebleau Resorts, LLC, et al., Eighth Judicial District Court, Clark County, Nevada, Case No. A637835;
  • Successfully representing a telecommunications company and its board members in an action brought by a shareholder, who sought to invalidate a merger, and who brought claims for breach of fiduciary duty and breach of contract.  See Kelly v. Blum, et al., Del. Ch. Ct., Case No. 4516 (VCP);
  • Obtaining a complete victory, including damages and attorneys fees, for a real estate investment fund in a "corporate divorce" dispute with its joint venture partner regarding a 550 acre real estate development project in Colorado;
  • Obtaining numerous favorable settlements on behalf of a publicly traded software company in actions for copyright and trademark infringement;
  • Obtaining a favorable settlement, prior to trial, on behalf of an apparel manufacturing company against competitor in case involving trademark infringement and cybersquatting violations;
  • Securing ex parte seizure orders, injunctions and other relief under the Lanham Act on behalf of luxury brand and athletic apparel manufacturers in actions involving the manufacture and sale of counterfeit products;
  • Negotiating a seven figure settlement on behalf of a generic pharmaceutical manufacturer in an action involving claims for misappropriation of trade secrets related to client's filing of an Abbreviated New Drug Application (ANDA) under the Hatch-Waxman Act;
  • Representing manufacturers of dietary supplements with respect to compliance with FDA and FTC Regulations; provided extensive advice to clients on conforming labels, advertising and marketing materials to meet FDA and FTC guidelines;
  • Representing trademark owners in proceedings in the United States Patent and Trademark Office (PTO) and Trademark Trial and Appeal Board; securing over 150 trademark registrations;
  • Representing a broker-dealer in a $32 million securities lending dispute; case settled on eve of trial with client recovering 98 percent of damages sought; and
  • Representing two broker-dealers in a series of securities fraud cases, NYSE arbitrations and SIPC proceedings arising from the collapse of a mid-western broker-dealer, MJK Clearing, Inc.; case involved, among other things, claims under the Securities Exchange Act of 1934 and Rule 10b-5; case settled favorably for clients prior to trial.
